Mates of mine in Northampton were two up on a bike heading from sywell to moulton they were going through overstone at a fair whack obviously no idea how fast but assured it was too quick, I imagine 12am-1am time, drink involved and the rider a known nut case I got on ok with him but he was nuts, lad on the back was a sound lad and both called Gary bizarrely….anyway both got a good amount of compensation …point is whoever pulls out is liable no matter the person with right of way is pissed, has no licence, no insurance, a fucking nut job, and is going a hell of a speed in a 30 limit …
Here in Merica, the insurance company will do anything they possibly can to deny the claim. They will argue that the impaired driver, drugs or drink, should not have been on the road and therefore the accident would not have occured. The biker who had 2.5 beers and is .001 over the limit would be 100% liable even if they were hit by someone driving completely recklessly. My former friend was hit from behind at a stop light while totally stationary, the insurance only offered him $2000.00 for the $3,700.00 of damage to his car, they claimed he was partly to blame as he could have decided to stay home and therefore would have avoided the accident. Insurance only insures you will pay them not that they will ever pay out

WTF...was there something in the small print of the policy to that effect?

Ex wife number two's dad was killed in a car crash on the interstate. He was hit from behind and his car was forced into the rear of a big rig. I tried to keep out of it other than support where you can. The vehicle that hit him, causing his death was insured only for a small amount so then her dads insurance had to pay up the expected compensation difference as he had paid for a higher level of insurance. Not only that but his killers insurance argued it should be less than asked as he was over 70 years and pro rata, didn't have many years left and was not earning an income as he was retired.

I always knew insurance companies earned their reputation as being Guinness's but the American way (in his case any way) was just pure avoidance of doing the right thing morally.
 
The Bodyshop called today to say the repair has been approved. They can't get it in till 14th July though. :( So 6 weeks of driving around in something that has been knocked so out of shape, it's in danger of being mistaken for a Bimota. 🤔
