That's it PIP!

I appreciate that this is boring everyone's tits off, but it is useful to me! I am ignorant of claiming and never claimed anything since I was at Uni, over 40 years ago - and that claim may have been dodgy as I was sponsored by Rolls-Royce and could always work for them in the holidays, if I wasn't such a lazy fucker!

Anyway, the conclusion is that when I get the insurance payout, then I will have to factor in paying back universal credit. But not PIP, I take it, as it is not means tested?
I hadn't claimed benefit until i left school for about a year then got my first job, one of many:rolleyes:, then my incident in 2016 i was advised by my then solicitor to caim benefit so i did for just over two years but wasn't told i had to pay it back, my first Solicitor was a useless Guinness so I went with White Dolten and they play on the fact they work for motorcyclists, they are fucking shit, DO NOT USE!!, they had a nice bit of money out of me and when i got my payout i coudn't claim benefit as my then wife worked full time so all i was getting was PIP, but not with the wife now so getting full benefit(y).
 
This has been useful and educational for me. I was asked and spent days (coz I moved banks) working out how much I had received, for my sol. So she knew this would be deducted, obviously.

If I remember correctly (and that is not a given) it was because you can get a figure from DHSS, but she does not trust them. I think the the other bastards (I mean insurance company) deduct it off and give it straight back to the DHSS. I think that she wanted the figure as she would not want to trust either the DHSS, or Hastings, to be correct. Well, DHSS to be correct and Hasting to be honest!
 
If you have an online bank account that your money is paid into, you can easily find out how much was paid to you. I believe esa is fortnightly and shows as esa on the statement. Universal credit is paid once a month and again will be highlighted what it is, the same as pip.

I get paid monthly.

Trouble is with my old, closed Halifax account. No problem with my Lloyds account as I can get go back to September 2020 when I started with them. Before that it was Halifax and I don't think that I can access anything. I can't remember my logon details anyway. It is not a show stopper as I had paper statements until some time in '19 and then I opted to stop paper and I've done all of those figures before.

I am only bothering to re-check my figures from when I began with Lloyds.

I lose interest quite rapidly on this, but I suppose it must be done.

My problem is that I have walking poles and if | was required to attend court then the temptation to take out anybody representing Hastings might be too tempting!
 
Is it worth taking suitable I.D. to your local Halifax branch and explaining the situation? People in Branch tend to be more helpfull face to face than a bod on the other end of a telephone?

Good advice, if I could be bothered too. I am pretty sure that I supplied pretty good figure about six months ago. My solicitor is not back until next year, now. She didn't seem concerned with what I provided before but I will double-check with her next year.
 
Despite reaching a settlement with the other side's insurance company, worth hundreds of thousands, my case is still swirling around he High Court:(

The question now, is do I have capacity? If the court decides that I don't, the Court of Protection get involved. If they do get involved, I somehow don't think that they will release me the cash to buy a new Monster+

Life is never ever simple.

Although I won my case, getting the Court of Protection involved means that effectively I have won nothing:(:(

What I really, really wanted to do was to get away from the shit of putting in expense claims for everything, like where I used to be. Today, for example, I would need to claim back my shopping bill and the price of that tower fan thing I bought. I thought that I had closed the book on this shit years ago, but now the High Court want it back open!

One pisser, is that it is all the fault of my elder brother! When I was unconcious after the crash, he appointed the solicitor and later when i started my hospital tour and spell in Wheatridge Court, he subbed me as my credit cards were all frozen and the shit bank turned its back on me. That was over four years ago. Since I have been home, I look after my own finances just fine. Any financial company that didn't stick by me has been given the boot and everything is cool. My brother is only my legal friend still, because my solicitor didn't think that there was any need to change things. The High Court case was originally in both of our names because it was started over two years ago and nobody thought that it mattered changing it, recently.

Now it fucking does as I am back to having to fight for my compensation. It makes I spit, it does! I fall into speaking Brizzle, when I am cross!

Can’t your doctor help here 🤷‍♂️ you live an independent life so I don’t see what the issue is 🤔

Who determines whether you have capacity or not?

My solicitor is on my side and is trying to end this shite. From her perspective, the case is won; compensation agreed; her fees agreed, and so let us all just move on. She has a contact who can look after the money for me and invest it, but that relationship is different in that I say that if I want £12k to buy a new Monster then they just arrange it i.e. I am in charge. I pay a fee for their time and skill in investing, but it is my money Simples!!!

I was going to take about £20 grand to give out to various family members for having to put up with me and the stress that I have caused them. Again, I just want to do it. Not go in to the ins and outs of a dog's arse to justify my expenditure. I took the pain and damage to my life, and now I want to reap the rewards, without having to put in claims and justifications to anyone else. I wouldn't of thought it is that controversial, but clearly the High Court do!

No doubt that If I wanted £20g to invest in some Bitcoin shite, they would question the wisdom of that! I am cool with that. They can do the investing, and I'll just do the spending. That is the relationship that I want. The High Court don't, though
 
Whilst you might think that you are fully compos mentis Perry, your mind can play tricks on you, and there may be good reasons (for your own good) to supervise how you dispose of (and how quickly) your award.

Bear in mind that whilst your life expectancy might be reduced, it also might not, and therefore you need funds to accommodate your reasonable living expenses over possibly decades.

Also, -For fuck's sake, don't let outsiders see the emails you put on here especially those cogitating on buying expensive "things" (y)

Be careful regarding Solicitors contacts who can look after your money, clear any important decisions with people you trust whether family members or professionals.
 
Do you really not know what the court of protection do?
If they are involved rest assured they are there to protect you and your money and if its you wasting it on motorcycles they will not interfere in any way.
When working I have recieved a number of complaints from the Court of Protection who have there own team of financial investigators about people in your position being abused
Some of the victims had capacity and some didnt

A Monster+ isn't expensive! Cheap as chips they are!!!

I don't think that it would be, and he really could really do without the hassle! He started this journey out of kindness when I was unconscious and nobody could say what the prognosis was. There was doubt that I would ever regain any mental capacity - even enough to boil an egg!

I am quite happy to go with what I discissed with my solicitor in London. That is, the money is passed along to her contact who will look after it for me. She is used to awards of over a million given to people with such serious brain injury that they are unable to manage their affairs. I can, but I can't be arsed to manage this sum of money. After I take out about £25,000 the rest needs to be sensibly managed. I might need to do more modifications to my house in later years. The feeling was that I might need to pay for private nursing care in later years, and maybe a stair lift. Whilst I said nothing in the negotiations as it got me more money, I don't think that this will happen, but it would be dumb to squander the money as I should always remain open to this possibility.

The psychologist that I saw twice in London, denies that she ever said that I will die soon. I accept that I may of got that wrong and nobody knows how long that I will go on for. I don't do being poor, so the sensible thing to do is to leave the bulk of the money invested so that is always there for me - to buy more Ducatis - no! no! start being sensible!!!

A good question and I do not know the answer. My sol will argue that I do have capacity (at least to annoy here!) so she will be trying to get me the money. Then it will be up to me to chose if I want to use her contact to look after the money for me.
