sat here with a poly sling on and a broken humerus thanks to someone coming in the opposite direction on shettleston road this afternoon - too busy speaking to her young daughter to see me - or even indicate that she was turning right into a side street - grrrr

on the plus side, i can confirm that the r&g aero bungs work pretty well when needed...

snapped off the bit the shoulder muscles attach to, so back in a week for probable surgery...

Hope you mend ASAP
Is the :jerkoff:that hit you picking up the tab for the bike & any time off work you may have??????

Bad news indeed. That sounds like a painful injury.

Hope you're on the mend soon. As Chiz said I hope you have the matter of liability in hand.

Let us know how you're getting on.

That's a bummer. Doing everything right and getting swiped by a day dreamer. Hope you get on the mend and mobile again soon.

Get better soon :) Get a specialist bike solicitor or one that has experience with bike claims, make sure every mark on the bike is TIC and any damage however slight to your bike gear. The driver should be prosecuted for dangerous driving. You can claim for loss of overtime as well as normal earnings, get a taxi account set up as you cannot drive and a cleaner once a week to clean the house.

thanks everyone.

feeling a bit achy today, but mostly smiling. ironically enough, i'd just left my chronic pain management course for the day when it happened, so at least i have a few tools and techniques (and heavy duty meds:D ) to deal with it

solicitor in hand, just waiting for a call back, got someone in to help 2hrs/week with practical stuff. unfortunately will have to head back down to a&e in a bit as polysling/shoulder immobiliser thing way too loose - rang nhs24 about it who said i should have really gone back down last night, but was about 4:30 by then, so couldn't be bothered.. must admit, part of me hoping chipped off bit has slipped off and they'll just use a bone screw or two, if it means i'll be riding again sooner

bike doesn't look too bad R&g crash bung, bar end, rear indicator - just spoke to Kerry at DG and will get bike recovered back to them (kind of knew i'd snapped something straight away, but just wanted to get home and bike perfectly rideable)

another annoying thing - was looking likely i was going to get a paid for trip to assen for a charity feature this summer - really don't want to miss out on that if i can...

anyway, just to say thanks again - you're all stars! :)

Oh not good news - however at least you are not too badly hurt and neither is the bike. Here's to a speedy recovery for you and an unmissed trip to Assen :)

Sorry to hear about the accident. There are too many dopey car drivers on the roads not paying proper attention to what's going on around them. Anyway, rant over, hope you get on the mend as soon as possible.

tbh, foxy's not wrong. i rode the bike 7 miles home, and feel like i could ride now if i took sling off - nowhere near as bad as a leg

i'll be back on the road asap :)

i'll do it when i can - friend of a friend (from Glasgow) owns bikemotel.nl and will visit regardless - want to get a few trips on bike in if i can - worst case 3months means still on bike for 42nd birthday :D

..and hoping for an indian summer

The Caveman will return, hope you took your club to dosey driver and clobbered her one... gave her one so to speak :D

how you feeling now mister? any news on op and how quick you can get back on bike?

hoping all works out well and you get bike sorted and back on the road in no time.

i'm fine, although a teensy bit bit gutted about not being out to play in this lovely weather....

now i'm not holding the shoulder as stiffly, i could quite happily remove the sling at times, as the one handed thing gets annoying quite quickly with the odd trivial chore, but will behave and keep it on for seven days as told..

seeing orthopaedic surgeon tuesday morning, so will find out then re: op etc. - knowing me, i'll be back on bike slightly sooner than am told is ok to...:p

bike looking ok thanks to r&g bung - bar end gone, rear indicator snapped, scratch on exhaust shield, brake lever bent, but could have been far worse without bobbin/mushroom/whatever they're called these days - should now be safely with DG and getting insurance assessment soon

another week of uncertainty :(

x-rays this morning still borderline, so back for more x-rays in a week re: bone screw op - wishing they'd just get on with it.
lower arm one side down to thumb is pretty numb, but can still resist ok with fingers etc., so doc says not to worry too much about it...

got to keep upper arm strapped where it is for next 7 days, but now allowed to unclip part of immobiliser to carefully flex elbow every now and again

- at this rate, i'm gunna have to be on the sofa, in front of the telly with a beer for the whole of the TT :D damn! ;)

It looks like a slow process then.
On the bright side, you have the TT to watch.

The crash will hit you in the pocket though, with all the time off.

lawyer already on case re: lack of earnings. ironically enough, i was on my way back from 5th chronic pain management class when it happened, i.e. not working anyway, but getting better - has said not unreasonable to claim for lost opportunity - have missed out on one contract, but had a call late last week about a 9 week gig starting mid-july covering extended leave for a delivery manager - hopefully that'll fit in well with the timing...

..and planning to be back on bike before then, even if it stings a bit, lol...:flash:

:)

had my 3rd set of x-rays this morning - looking much better - could see a huge difference looking at em myself when he showed me - said he was surprised was only 2 weeks :)

i'm not allowed to move arm out to side as could still snap bit off again yet, but out of the 24/7 shoulder immobiliser and just a little collar and cuff thing on now, which i can take off for dressing, bathing, exercise etc., and a couple of exercises to do,

back in 2 weeks for another check with ortho doc, and maybe the all clear to go riding again :D:flash::cool:

...aaand back up again :D

got the all clear to ride from my doc this morning - just waiting on a call back from CN about a hire bike while waiting for Monster parts...:flash:

woo

and

hoo

:D

:mad2: just received and read this from accident lawyer - was sent this afternoon... :mad2:

"Please note I have now received a response from the third party insurers. Their client alleges that you were undertaking a vehicle on approach to the junction. Upon reviewing this case it is clear that it is your word against the third party’s and unfortunately there are no independent witnesses to support either version of events.

As you are aware the third party insurers have offered to settle this matter on a split 50/50 basis due to the conflicting version of events and lack of independent witness evidence. If you reject this offer the only option would be to raise court proceedings against the third party however I must make you aware that this does not guarantee a successful outcome. The evidential burden rests on you, as the pursuer to prove, on the balance of probabilities, that the other party was at fault. If you both give equally credible and reliable accounts of what happened, then the Sheriff will have nothing to justify a finding in your favour.

It is therefore important that you understand that that there are three possible outcomes if court proceedings are issued:

1. Sheriff prefers your version of events and finds in your favour holding the third party liable for the accident

2. Sheriff prefers the third party’s version of events and you are wholly unsuccessful

3. Sheriff may reach a split liability decision although that is the least likely scenario

I would urge you to give careful consideration to the options at this stage. If you do not wish to accept the offer of 50/50 then we are prepared to issue proceedings on your behalf however I would be reluctant to begin proceedings whilst you are still suffering significantly from your injuries. I would suggest waiting until you have been discharged from physiotherapy then obtaining medical evidence.

I would be obliged to receive your instructions on this matter.
"

There sure as hell was no other vehicle in front of me.

I have instructed lawyer to start proceedings immediately.

I want to look into the eyes of that mother who was running her child home from school that day, and couldn't apologise enough, and see if she is willing to lie in the Sheriff's Court too..
If she is so low as to do so, i hope her child is there to witness it...

Sounds like your solicitor is going for the easy option and hoping you will go for the less hassle option. Don't go 50/50 as it will seriously damage your insurance history.
